Did you know the Govt passed a new Social Housing law this summer ? “The Housing and Residential Tenancies Act 2026”
This Act sets the rules for asylum seekers’ access to social housing
To qualify for social housing you must be “lawfully resident” and “habitually resident” in Ireland. “lawfully resident” includes:
• Refugee status
• Subsidiary protection
• Permission to remain
• Programme refugee status
• Certain qualifying family permissions
So once someone moves from being an asylum applicant, they have an immediate legal gateway to the social housing list.
Social housing is NOT for citizens only. And To be clear: Until this summer, the rules governing migrants’ access to social housing were largely contained in a Departmental circular from 2012.
The Govt has now written them directly into law. This was a chance to tighten up access to social benefits.
Remember the Govt admit most are “economic migrants” But Instead they have doubled down.
This directly affects the housing crisis. It puts new arrivals in direct competition with with disability campaigners & others for housing resources. Why are they doing this?
